Welcome to Business Moguls (the “Website”), operated by Akeisha of Business Moguls (“Company,” “we,” “us,” or “our”). Your privacy is important to us. This Privacy Policy explains how we collect, use, protect, and disclose personal information when you use our Website and related online services (collectively, the “Services”)
1. Introduction
This Privacy Policy explains how Business Moguls, LLC, a Georgia limited liability company (“Business Moguls,” “we,” “us,” or
“our”), collects, uses, discloses, and protects information in connection with the Business Moguls website and CRM platform,
including our calling, texting/SMS, email, calendar, social media posting, and AI features (collectively, the “Service”).
This Policy applies to two categories of people, and it’s important to understand the difference:
Customers — businesses and individuals who register for a Business Moguls account and use the Service (“you,” “Customer”).
Contacts — the leads, customers, or other individuals whose information a Customer uploads into the Service (“Contacts”).
If you are a Contact and want to know how a specific business is using your information, please contact that business directly — we act on their instructions with respect to that data. See Section 3.2.
By using the Service, you agree to the collection and use of information as described in this Policy. If you do not agree, please do not use the Service.
2. Information We Collect
2.1 Information You Provide Directly
Account information: name, email address, phone number, company name, billing address, and payment information (processed by our payment processor — see Section 5).
Communications with us: support requests, survey responses, and other correspondence.
Content you create: email templates, call scripts, social media posts, calendar events, and other content you input or generate
using the Service, including via AI Features.
2.2 Customer Data You Upload (Contact Information)
As part of using the Service, you may upload or import personal information about your own leads and customers, which may include
names, phone numbers, email addresses, physical addresses, notes, call recordings, and message history (“Customer Data”). With respect to Customer Data, you are the data controller and we act as a data processor/service provider acting on your instructions.
See Section 3.2 for more on this relationship.
2.3 Information Collected Automatically
Usage data: pages viewed, features used, click patterns, session
duration, and similar analytics.
Device and log data: IP address, browser type, operating
system, device identifiers, and timestamps.
Cookies and similar technologies: see Section 7.
Call and message metadata: when you use our calling/textingfeatures, we collect metadata such as call duration, timestamps and phone numbers dialed. If you enable call recording, we store the recording as described in Section 2.4.
2.4 Call Recordings
If you use our call recording feature, recordings are stored in your account. You are solely responsible for providing any legal notice or obtaining any consent required under applicable two-party or all-party consent recording laws before recording a call. We are not a party to your calls and do not monitor them for legal compliance.
2.5 Third-Party Integration Data
If you connect third-party accounts (calendar providers, email providers, social media platforms, telephony carriers), we receive information from those platforms as authorized by you and by that platform’s permissions, such as calendar availability, social account posting permissions, and contact lists you choose to sync.
2.6 Information from AI Features
When you use AI Features, we process the prompts, inputs, and Customer Data you provide to generate outputs (e.g., drafted emails, call scripts, social posts). See Section 4.4 for how this data is used and Section 4.5 for model training.
3. How We Use Information
3.1 To Provide and Improve the Service. We use information to operate the Service, process payments, provide customer support, send administrative and transactional communications, and maintain security.
3.2 Our Role With Customer Data. With respect to Customer Data (personal information about your Contacts that you upload), we act only as a service provider/processor on your behalf. We do not use Customer Data for our own independent marketing purposes, do not sell Customer Data, and only process it: (a) to provide the Service to you, (b) as you instruct through the Service’s features, or (c) as required by law. If we use Customer Data to improve or train AI models, that use is disclosed and controllable as described in Section 4.5.
3.3 To Communicate With You (Our Customer). We may send you product updates, billing notices, security alerts, and — where you have opted in or as otherwise permitted by law — marketing communications about Business Moguls. You may opt out of marketing communications at any time using the unsubscribe link or your account settings; you cannot opt out of essential service and
billing communications while your account is active.
3.4 For Analytics and Product Development. We use aggregated and de-identified usage data to understand how the Service is used and to improve features.
3.5 For Legal and Safety Purposes. We may use information to detect fraud, enforce our Terms of Service, and comply with legal obligations.
4. AI Features and Data Use
4.1 How AI Features Process Data. When you use AI Features (e.g., AI-drafted emails, call scripts, chat/voice-agent responses, social content, lead scoring), we send the relevant inputs — which may include Customer Data — to AI models to generate outputs. This may include processing by third-party AI model providers acting as our subprocessors under contractual confidentiality and data-use restrictions.
4.2 Human Review. AI-generated output is not reviewed by a human before being returned to you. You are responsible for reviewing AI outputs before sending, publishing, or relying on them, as described in our Terms of Service.
4.3 Automated Decision-Making. Certain AI Features (such as lead scoring) may involve automated processing that produces a recommendation or score. These are provided as decision support for you, the Customer — Business Moguls does not use these outputs to make legal or similarly significant decisions about your Contacts, and any such decisions made by you using our tools are your responsibility.
4.4 Data Retention for AI Processing. Inputs and outputs processed through AI Features are retained consistent with Section 8 (Data Retention) and are not shared with other Customers.
4.5 Model Training.
“We do not use your Customer Data or account content to train AI models that are shared with or benefit other customers.”
"We may use de-identified and aggregated inputs and outputs from AI Features to improve and train our AI models. You can opt out of this use in your account privacy settings.” Choose the option that is factually true and keep it
consistent with Section 8.4 of the Terms of Service.]
5. How We Share Information
We do not sell your personal information. We may share information
as follows:
Service providers: payment processors, cloud hosting providers, email/SMS delivery providers, telephony carriers, and AI model
providers who process information on our behalf under contractual confidentiality obligations.
Third-party integrations you connect: if you connect a calendar, social media, or other third-party account, information flows to and from that platform as authorized by your connection and their own terms.
Legal requirements: if required by law, subpoena, or legal process, or to protect the rights, property, or safety of Business Moguls, our users, or others.
Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.
With your consent: for any other purpose disclosed to you at the time of collection with your consent.
6. Communications Compliance Disclosures
6.1 SMS/Text Messaging. If you (as a Customer) use our texting features to message your Contacts, message and data rates may apply to those Contacts, and Business Moguls is not responsible for obtaining consent on your behalf — see Section 6 of our Terms of Service. Contacts may reply “STOP” to opt out of messages sent by a Customer through the Service, and we maintain suppression list functionality to help Customers honor these requests.
6.2 SMS/Text Messaging
If you opt in to receive SMS/text messages directly from Business Moguls, we may collect your mobile phone number, SMS consent status, and related messaging preferences. We use this information to send the customer care, transactional, and/or marketing messages that you have specifically agreed to receive.
6.3 Message frequency may vary. Message and data rates may apply. You may reply STOP at any time to opt out of further SMS messages or reply HELP for assistance. Consent to receive SMS messages is not a condition of purchase.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent will not be sold, rented, or shared with third parties or affiliates for their own marketing purposes.
We may share mobile information with service providers that assist us in operating and delivering our SMS communications, such as telecommunications carriers and messaging service providers, solely as necessary to provide those services on our behalf and subject to appropriate confidentiality and data protection obligations.
If you use Business Moguls as a Customer to send SMS/text messages to your own Contacts, you are responsible for obtaining all legally required consent before sending messages. Contacts may reply STOP to opt out, and the Service provides suppression-list functionality to assist Customers in honoring those requests.
6.4 How do end-users consent to receive messages?
End users opt in to receive SMS messages through the Business Moguls website at https://businessmoguls.org/contact-us.
Users enter their contact information and may independently select one or both optional SMS consent checkboxes. Both checkboxes are unchecked by default, and SMS consent is not required to submit the form.
The first checkbox provides consent for non-marketing/customer-care messages, including appointment reminders, business updates, sales follow-ups, and transactional communications.
The second checkbox separately provides consent for marketing and promotional messages, including special offers, discounts, business resources, event invitations, and service updates.
Each disclosure identifies Business Moguls as the sender and states that message frequency varies, message and data rates may apply, users may reply HELP for assistance and STOP to opt out, and consent is not a condition of purchase.
6.2 Email. All commercial emails sent through the Service must include a functional unsubscribe mechanism and comply with CAN-SPAM, per our Terms of Service. We track unsubscribe requests to help maintain suppression lists.
6.3 Calls. Call recording, if enabled, is subject to Section 2.4 above.
7. Cookies and Tracking Technologies
We use cookies and similar technologies (such as pixels and local
storage) for:
Essential functions: authentication, security, and core site functionality.
Analytics: understanding usage patterns (e.g., via tools like Google Analytics). Preferences: remembering your settings. You can control cookies through your browser settings. Disabling essential cookies may affect Service functionality.
8. Data Retention
We retain account information for as long as your account is active and for a reasonable period afterward for legal, tax, and backup purposes. Customer Data is retained per Section 10.5 of our Terms of Service (deleted or anonymized within 90 days of account termination, subject to legal/backup exceptions). Call recordings and message history are retained for as long as you keep them in your account, or per your configured retention settings.
9. Your Privacy Rights
9.1 U.S. State Privacy Rights. Depending on your state of residence (e.g., California, Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws), you may have the right to:
- Know what personal information we have collected about you;
- Request access to or a copy of your personal information;
- Request correction of inaccurate information;
- Request deletion of your personal information;
- Opt out of the sale or “sharing” of personal information for targeted advertising (we do not sell personal information);
- Not be discriminated against for exercising these rights.
To exercise these rights, contact us at [email protected]. We will verify your identity before fulfilling a request. Note: if you are a Contact whose information was uploaded by one of our business Customers, we may need to direct your request to that Customer, who controls the data (see Section 3.2).
9.2 California “Shine the Light.” California residents may request information about disclosures of personal information to third parties for their own direct marketing purposes. We do not share personal information for third-party direct marketing purposes.
9.3 International Users. If you access the Service from outside the United States, including from the European Economic Area or United Kingdom, please note the Service is operated from the United States, and by using the Service you consent to the transfer of your information to the United States.
10. Data Security
We implement commercially reasonable administrative, technical, and physical safeguards designed to protect information from
unauthorized access, use, or disclosure, including encryption in transit, access controls, and regular security reviews. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
11. Children’s Privacy
The Service is intended for business use by individuals 18 and older and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn we have inadvertently collected such information, we will delete it. Contact us at [email protected] if you believe a child has provided us information.
12. Third-Party Links and Integrations
The Service may contain links to or integrations with third-party websites and platforms (social media platforms, calendar providers,
payment processors). We are not responsible for the privacy practices of those third parties. Review their privacy policies before providing information to them.
13. Do Not Track
Some browsers offer a “Do Not Track” signal. Because there is no industry-standard response to these signals, our Service does not
currently respond to them.
14. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or in-app notice at least [14] days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Policy.
